Rajah & Tann Singapore is acting for an individual and related Singapore-based and Myanmar-based entities, all of whom are involved in the trading of hydrocarbon products, in various disputes with another oil trading group relating to the breakdown of a joint venture in Myanmar, which was set up to import and trade hydrocarbon products in Myanmar. The complexity and scale of this matter arises from the fact that there are various arbitration and court proceedings in Singapore and Myanmar, many of which had a bearing on another. There were also related criminal investigations in Myanmar.
In particular, in two of the arbitration proceedings, the underlying facts material to the disputes all took place in Myanmar: one pertained to alleged breaches of a shareholders’ agreement arising from acts done in Myanmar; the second pertained to disputes with a third party storage provider, who had refused to deliver the cargo stored in its tanks after being notified of competing claims over the cargo by the opposing oil trading group.
The firm successfully assisted the clients in negotiating a global settlement involving 17 parties and across 11 disputes.
The matter is led by Partners Lee Eng Beng SC, V Bala and Disa Sim, and supported by Torsten Cheong (Partner), Rebekah Lau (Senior Associate), Chan Qin Pei (Senior Associate) and Jodi Siah (Associate).
