Telekom Malaysia’s successful upgrade to a Facilities-Based Operator licence in Singapore

Rajah & Tann Singapore advised Telekom Malaysia (S) Pte Ltd (“TMSG”) on the legal and regulatory requirements for it to upgrade its licence from a Services-Based Operator to a Facilities-Based Operator (“FBO”) licence, given its proposed expansion of operations and service provisioning in Singapore.

We also assisted TMSG in drafting and refining its FBO licence application to the Infocomm Media Development Authority (“IMDA”). As the FBO licence is on the highest hierarchical level of the Singapore telecom licensing framework, the licence application was subject to intense review by IMDA. We represented TMSG in all correspondence and clarifications with IMDA regarding the licence application.

As part of the process, we had multiple discussions with TMSG to advise the client on the relevant regulatory requirements and implications, and the appropriate strategy to take vis-à-vis the regulator in the licence application.

We succeeded in helping the client obtain the necessary FBO licence for them to commence their intended activities in Singapore.
